December Update: Launch of Medical Cannabis Sales in Kentucky and New OMC Guidance

This month marked a major milestone for Kentucky’s medical cannabis program as the first medical cannabis sales occurred with the opening of The Post Dispensary in Beaver Dam.  Patients with qualifying conditions and medical cards can now purchase regulated products under Kentucky law, with the supply of medical cannabis/medical cannabis products and the number of dispensaries to increase across the state in 2026.  

The Kentucky Office of Medical Cannabis (“OMC”) issued two technical advisories in December as the office continued to complete on-site inspections for licensees that are ready to commence operations.   

In these recent guidance documents, OMC emphasized that licensees must have complete and clear video surveillance coverage of all areas where medical cannabis is “housed, worked with, and/or transported through.”    

OMC also outlined the process and timelines for cultivators to bring in start-up inventory—which is permitted for 60 calendar days after receiving approval to commence operations—and to request additional inventory thereafter.
